The Islamabad High Court (IHC) has ordered immediate sealing of Pakistan Navy Sailing Club on the shores of Rawal Lake.


(Sindh Tribune) : ISLAMABAD: The Islamabad High Court (IHC) has ordered immediate sealing of Pakistan Navy Sailing Club on the shores of Rawal Lake.

 On Thursday, Chief Justice of the Islamabad High Court, Justice Athar Minallah, heard a petition against the alleged illegal construction of the Pakistan Navy's Sailing Club on the shores of Rawal Lake.

 The Capital Development Authority (CDA) filed a reply in the court saying that the Prime Minister of Pakistan had given permission for construction near Rawal Lake.

 The court asked where is the land allotment letter from CDA?

 The CDA board member told the court that the allotment letter did not exist and had not been approved.

 The court then asked the CDA representative what action it had taken.

 CDA board members say we have issued notices on which the court expressed anger and said what is the point of giving notices, what does CDA do with a poor man, why is this double standard being maintained?  ۔  Go and demolish the illegal building.

 The court issued orders to seal the sailing club immediately.

 The Chief Justice said that the Chairman CDA and CDA Board members should submit affidavits, why not take legal action against the CDA for alleged negligence.

 The court inquired under which authority the Pakistan Navy was running the commercial project, this is not the tribal area but the capital of the country.

 When Justice Athar Minallah questioned the CDA board member as to whether the building of the Navy Sailing Club was legal or illegal, the CDA representative said that it was unapproved.

 Chief Justice Athar Minallah remarked that what is unapproved?  "This means it is illegal. CD board members are reluctant to say that the commercial building belongs to the Pakistan Navy and is illegal."

 Secretary Cabinet Division go and seal the sailing club and remain sealed till the next hearing.  If the sailing club is not sealed, the secretary should appear in the next court and submit the reply.

 The court asked the CDA board member who owns the area around the sailing club.  Why are people not allowed to go there?

 A representative of the Pakistan Navy asked the court for time to file a reply, to which Justice Athar Minallah said, "What time is it?"  No one, including this court, is above the law.

 We respect you, we are ready to make all kinds of sacrifices for your martyrs, but if you do illegal things, you will also abuse these martyrs.

 The Additional Attorney General asked the court for permission to assist, to which the court restrained him, saying that you cannot assist, go first and seal the sailing club and take the matter to the Federal Cabinet.  Under what law and authority has the Navy started commercial projects?

 The court said the CDA's response was shocking.  Why not take legal action against the CDA for alleged negligence?
